Agreement to Terms

By accessing or using ClubStats (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.

Service Description

ClubStats provides a cloud based platform that enables clubs to upload, import, manage, analyse, and visualise their data for their own use and operations.

Account Registration

You must ensure that all account information is accurate and kept up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Data Ownership

You retain full ownership of all data uploaded, submitted, or authorised for import into the Platform ("Customer Data"). We process Customer Data to provide the service to your club.

Data Responsibility and Authorisation

You confirm that you are authorised to upload or approve the import of Customer Data, that your use of the Platform complies with applicable laws, and that you are comfortable using any connected third party sources for that purpose.

Data Source Compliance and Responsibility

The Platform operates on data provided, uploaded, or authorised by your club.

Your club is responsible for ensuring it has the appropriate rights, permissions, and consents to use, process, and analyse that data through ClubStats.

This includes any terms or usage requirements that may apply to connected third party systems, competitions, governing bodies, or data providers.

We work with the data and integrations your club authorises as part of delivering the service.

Data Processing Role

ClubStats acts as a service provider and data processor, providing tools to store, analyse, and visualise Customer Data.

User Controlled Data Import

Any data import functionality provided by the Platform is initiated and controlled by the user.

Imports are based on the files, exports, or connections your club chooses to use with ClubStats.

Best Effort Data Imports

Where ClubStats supports authorised data imports from third party systems, those imports are delivered using the data and access made available by those systems.

Because source systems may evolve over time, import behaviour or available fields may occasionally change.

Where needed, your club can continue to provide data through alternate import methods such as CSV or Excel exports.

Subscription and Fees

Subscriptions are billed annually unless otherwise agreed and are non refundable except where required by law.

Historical data import services are included as part of the ClubStats service.

Acceptable Use

You must use the Platform lawfully, only upload or authorise data you are entitled to use, and avoid interfering with the normal operation of the Platform.

Intellectual Property

All intellectual property in the Platform, including software, analytics models, and design, remains the property of ClubStats.

No Affiliation or Endorsement

ClubStats is an independent platform built for clubs and may work alongside other cricket systems and data sources where appropriate.

Accuracy Disclaimer

We aim to present data accurately based on the information provided to the Platform and encourage clubs to review imported or uploaded records as part of their normal workflows.

Limitation of Liability

To the maximum extent permitted by law, our liability is limited to direct loss reasonably connected with the service, up to the fees paid in the previous 12 months.

Third Party Data and Indemnity

Your club remains responsible for the data and permissions it supplies to the Platform, including any third party source terms that apply to that data.

Termination

Access may be suspended or terminated where required to protect the service, manage billing, or address material misuse of the Platform.

Data Retention and Deletion

You may request deletion of your data at any time. Upon termination, data may be deleted after a reasonable retention period.

Governing Law

These Terms are governed by the laws of Western Australia.
